the Mortgagees then the Mortgagees shall and will at the request

cost and charges of the Mortgagor reassign the said Coal or so

much as thereof as shall then be unsold AND IT IS HEREBY DECLARED

that if default shall be made in payment of the said sum of Two

hundred thousand Dollars or the interest or any part thereof respectively at the time or times herein appointed for the

payment thereof respectively the Mortgagees may without any further consent on the part of the Mortgagor sell the said Coal or any part thereof either together or in parcels and either by

public auction or private contract or partly by public auction

and partly by private contract and subject to such conditions of sale and stipulation as the Mortgagaon shall think fit and

may buy in or rescind any contract for sale and resell from

time to time without being responsible for loss occasioned

thereby AND may execute and do all such assurances and things

for effectuating any such sale as the Mortgagees shall think

fit PROVIDED ALWAYS that the Mortgagees shall not execute the

aforesaid power of sale before the Thirty First day of December

one thousand nine hundred and five unless or until the whole or

part of some payment of interest shall be in arrear for one

month PROVIDED ALWAYS that upon any sale purporting to be made

in pursuance of the aforesaid power no purchaser shall be bound

to inquire whether such case has happened nor whether any money

remains upon this security nor as to the propriety or regularity

of such sale and notwithstanding any impropriety or irregularity

whatsoever in any such sale the same shall as regards all

purchasers be deemed to be within the aforesaid power and be

valid accordingly PROVIDED ALWAYS that the receipt in writing

of the Mortgagee■ for all or any of the purchase money of the

premises sold shall effectually discharge the person paying the

same therefrom and from being concerned to see to the

application thereof or being accountable for the loss non-

application or mis-application thereof AND that the Mortgagees

shall out of the money arising fron any such sale as aforesaid
